Transgender Drug Testing

Recently, a client asked me if they needed to adjust their drug testing policy so a transgender employee could choose the gender of the person observing them urinate for a test. Obviously, the person wanted the employee to feel comfortable with who was in the room with them. First of all, having another employee watch you urinate can be uncomfortable for anyone, for any reason, but it is a requirement for some drug tests in order to ensure that the testee doesn’t bring in a bag of someone else’s urine to exchange as their own. If the reason is not obvious, it is so they do not test positive when they know they have been under the influence of drugs or alcohol. So, I did some research and thought it would be good to share this information for other employers, managers, small business owners and HR managers who may have similar questions. What are the requirements to be an observer for a direct observed collection? According to the Mandatory Guidelines for Federal Workplace Drug Testing ...

HR Legislative Update Covering: Lactation Room, Nursing Mothers, Severance & EMS Rest Exclusion

Several new laws have taken effect in the last year that affect Public Employers primarily.  Please review this legislative update carefully and contact me for any further information you may need to ensure compliance. P.A. 100-0947 (January 1, 2019) – This Act amends the Counties Code to require that on or before June 1, 2019, every facility that houses a circuit court room shall include at least one lactation room or area for members of the public to express breast milk in private that is located outside the confines of a restroom and includes, at minimum, a chair, table, electrical outlet, and a sink with running water where possible.  This room may be the same space provided to employees. The legislation further requires the Supreme Court to create minimum standards for posting and training of courthouse staff. Construction or renovation of a court facility after June 1, 2019 shall include at least one lactation room or area that is located outside the confines of a res...

Disciplinary Action up to and Including Termination

My blogging has been pretty sporadic lately! I just finished an overload semester and had a boat load of client work to handle as well. So unpaid work gets pushed aside. I hope to get more regular on this site as time moves forward. Here's a summary of some of the main points related to a program I delivered last week to over 70 management personnel. Recently, I facilitated a training event in Springfield covering the topic above. The exact wording used in the title can often be found at the end of a personnel or employment related policy reminding employees to follow the rules (i.e. policy) or else! The problem is that many times management doesn't enforce those policies because conflict for anyone is not easy and often avoided at all costs. However, the long-term costs to a company for not enforcing can lead to poor performance, attitude, increased turnover, decreased morale of other employees, unfair or inequity complaints to outside agencies or an attorney. So botto...

Social Learning Platforms in the Classroom?

Yes, social learning platforms are in my classrooms (face-to-face, blended, and online) and have been part of my teaching methodology since 2011 or so.  I personally got online around 2008 not too long after social media started getting popular among the business community.  My first blog was actually on my original website (although clunky) because I remember writing a blog post about my very first Facebook post featuring my kids.  Of course, it took me a couple years to master all the start ups and I think twitter became a favorite in 2009 or 2010.  I remember, many of my SHRM friends showed me how to use twitter at conferences.  Twitter which is where I have my strongest following currently with just under 20k unique followers (no purchased lists - wouldn't even think of doing that).  In those early days, it seems like the Human Resource community was among the first to adopt the technology even though many of their employers were still strongly forbiddi...

Calling All Strategic HR Mgt Contributors

The 2nd in a series about Strategic Human Resources Management: This is the second in a series of posts related to the Strategic Human Resources Management course I am teaching here at the University of Illinois Springfield.  This is a shout out to all those I have researched and the students will be researching who are considered by others as contributors to the field.  In addition, it is my way of asking for advice, information, and suggestion on who else might be out there that I have yet to run across. Since the names will be researched and papers will be written on each of them individually to learn more about the field and what contributions have been made, I am specifically searching out those who have published or speak regularly about the topic.  So if you have a moment please comment with any insight you may have and/or share this blog post with others you think may be helpful.  In the meantime, here is our first stab at a shout out for Strategic HRM co...

Management Should Know Thyself before Managing Others

One of the most important outcomes of my Organizational Behavior class is the self analysis each student completes during the course.  There are several assessments covering topics such as personality, leadership, decision making, and more.  This coupled with a semester long look at how individual, group, and organizational behavior affects the results (good or bad) of a company leaves each student with their own impression of what it takes to be a good leader or manger.  The following is a brief summary of just how one of my A students Galen F. Schneider views the world as it relates to the topic in the Title above:          Five big traits every good manager needs to possess in order to succeed not only in the business world, but also as a manager, are: 1.        A high motivation to manage 2.        A moderately high to high self-monitoring tendency 3. ...
